These Terms and Conditions apply when you use this website and purchase any items from Gold Coast confectionery. Please also read our Privacy and Cookies Policy which sets out how we collect, process and use your information. By using this website each time you place an order with us, you are agreeing to these Terms and Conditions, and our Privacy and Cookies Policy. If you do not agree, please do not use our website.
We reserve the right, from time to time, with or without notice, to change these Terms and Conditions at our sole discretion, and the latest version will appear on our website with the date that it was last updated. By using the service after any changes have been posted, you agree to the new terms.

To register with www.gcconfectionery.com.au and purchase goods from our website, you must be over 18 years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering, by updating your personal details. You must give us your real name, address, phone number, email address and any other details that we may require to process your order. Any access codes or passwords provided should be safeguarded at all times. You are responsible for the security of your access codes and passwords and will be solely liable for any use or unauthorised use under such access codes or passwords. We may suspend or terminate your access at any time with or without notice. To understand how we use information collected from you, please read our Privacy Policy.
We reserve the right to: Decline a new customer registration or suspend a customer's account at any time and at our sole discretion. In our absolute discretion, to terminate your access to all or part of the services with or without notice. In our absolute discretion, to discontinue the website or services, or any part thereof, at any time, with or without notice.
Availability
Goods are subject to availability. Our acceptance of your offer to purchase our goods is subject to their availability. Our acknowledgement of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods within the times given on the site during the order process, which you have offered to purchase, we will let you know as quickly as possible and a full refund will be given. Note that during peak periods we have the right to extend normal lead times by 2 or 3 days, though this will be notified to you on the site.
Pricing, Description & Product Information
The prices which you must pay for the products that you order are set out on the website at the time you place your order, except where we discover an error in the price of the products you have ordered. In this event, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. The prices quoted on this website apply only to products sold via this website. Where the same products are available via another stockist then different prices may apply. All prices are shown in Australian Dollars and include GST where applicable. Although we will take all reasonable care to ensure that all descriptions, images, details and prices of products appearing on the website are correct at the time when the information was entered onto the system, the information appearing on this website at any time may not reflect the exact position at the moment you place an order. All measurements and sizes are approximate, although we make every effort to ensure that they are as accurate as possible. There may also be variations in colour from the image shown online.
Placing an Order & Order Acceptance
The Order Acknowledgement email and order number are our confirmation of your order with us. Completion of the contract between you and us will take place on dispatch to you of the products ordered, unless we have notified you that we do not accept your order, or you have cancelled it. Our carrier will make every reasonable effort to contact you to make delivery, but, if they are unable to do so, then your order will be cancelled, and payment refunded to your card.
Refunds: If you cancel an order within the seven-day cancellation period we will refund you as soon as possible. We will refund the price of the products using the same method originally used by you to pay for your purchase.
Dietary Information - The products included in our items/products and on our site, are made in the same environment as nuts, peanuts, coconut, gluten and diary and therefore we cannot guarantee that they are free from nut, peanuts, coconut, gluten or diary traces. Online Gift Card Terms & Conditions
Gift Cards are accepted online as a method of payment. To use your Gift Card online at www.gccoastconfectionery.com.au simply enter the Gift Card code number at the checkout page to redeem the credit towards your purchase. Any balance remaining after your transaction will remain on the card.
The value on the Gift Card will expire if not used within 12 consecutive months from the date of purchase. Gift cards are exempt from all offers online and they cannot be discounted or used to purchase another Gift Card.
The Gift Card is not a cheque guarantee, credit, debit or charge card and cannot be exchanged for cash, returned or refunded, except in accordance with your legal rights. Gift Cards cannot be used for payment in in third party department stores or independent retail outlets.
A Gift Card is intended for your personal use and, as such, you are not entitled to sell, distribute or otherwise make any commercial use of your Gift Card. For the avoidance of doubt, this shall not prevent you from giving a Gift Card as a gift, provided that such gifting is not part of or connected to any commercial activity, unless otherwise agreed in writing.
Payment
We take payment from your card at the time we receive your order, once we have checked your card details and stock availability. Payment must be made with a valid credit or debit card acceptable to us. Where you have input a different delivery address to registered card address, we reserve the right to refuse the order where we suspect fraud or otherwise breaking these terms. You can register a new payment card at any time, but the card associated with a given order cannot be changed once you have checked out.
Delivery
Provided that we have processed and received payment in full for the products, ownership of an item will pass to you once we have delivered the item to you (either directly, or by leaving it in a safe place or with a neighbour). When an item has been delivered, risk of damage to, or loss of, the item passes to you. For specific delivery options, including international order delivery, please read our delivery section.
Whilst we take every care to ensure that deliveries are protected to prevent damage in transit, we cannot guarantee that parcels being sent to areas outside of Australia will arrive in perfect condition. Please note that working days for us are Monday - Friday and do not include Australian Public holidays.
Cancellations & Returns
This includes your right to cancel your order. If your order has already been dispatched please refer to our returns information. We hope you are happy with any product purchased, but if you wish to return a product to us for any reason we are unable to accept any returns of perishable goods due to the COVID-19 Health regulations.
Refunds & Exchanges
All refunds will be made to the debit or credit card on which the original purchase was made, within 30 days of the cancellation of the order. In the event that Gold Coast Confectionery is unable to credit your original method of payment, we will contact you to arrange an alternate method of refund. On tampered products, after the 14 day cancellation period. We also reserve the right to offer a replacement item of similar or equal value.
Promotions & Discounts
In order for a promotion or offer to be applied to your order, a valid promotion code must be entered into the promotion code box on the checkout page. Gold Coast Confectionery cannot be held liable for not discounting the order if a valid code has not been entered. If placing an order by telephone you must quote the promotion code before placing your order. Promotions and promotional codes are subject to the terms and conditions specified by Gold Coast Confectionery at the point of purchase. Only one code can be used per order.
Please note: Discount codes will not apply to any existing offers or promotions.
Website Changes & Updates
In order to keep our website as accurate and as up to date as reasonably possible, it may be necessary, from time to time, to restrict access to the site in order to undertake necessary maintenance work. We will make every effort to ensure that any down time or restricted access is kept to a minimum. Registration data and certain other information about you is subject to our privacy policy. We recommend that you read our Privacy Policy before you accept these terms and conditions.
Intellectual Property & Copyright
The content of www.gcconfectionery.com.au website is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the website on a computer screen, store such content in electronic form on disc (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the website without written permission from Gold Coast Confectionery.
Limitations
This website and any software are provided on an "as is" basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement.
Indemnity
You agree to indemnify and hold Gold Coast Confectionery free from all liabilities, claims and expenses that arise out of the content you submit, post or transmit via the Gold Coast Confectionery website, or from your use/misuse of the website, or the use/misuse by any person for whom you are responsible or from your violation of the terms and conditions.
Governing Law
The contract between you and Gold Coast Confectionery under which you have made your purchases, it is agreed, shall be governed by, and interpreted in accordance with, Queensland law. The Queensland courts shall have jurisdiction to resolve any disputes between us. This does not affect your statutory rights.

We always welcome feedback from our customers and, whilst we always use all reasonable endeavours to ensure that your experience as a customer of ours is a positive one, we nevertheless want to hear from you if you have any cause for complaint.
